If you have a short secure rent, your landlord can inform you in writing that they wish to own the property at least two months before the original fixed life expiry or at any time thereafter. You can communicate during the lease on the agreed termination date. If you do not evacuate the property at that time, your landlord may take legal action against you. Short leases are the most commonly used type of rental in the PRS. They must be properly set up and last at least 6 months. Any rental agreement that started on or after December 1, 2017 is a private residential rent. This new rent will replace the secure and short rent and will make changes and improvements for the private rental sector, including notice periods: a tenant can complete a TRP with a 28-day period at any time (the parties may agree to adjust this notice after the lease begins). The lessor must issue 4 weeks` notice if the lease is within the first 6 months or after 12 weeks` notice. You can use this form to create a Scottish Tenancy Agreement (MTA) model for private residential rent.

The MTA includes: For example, your lease could say, “The property is leased for six months and then monthly.” This would mean that your lease would last six months and it could then be renewed one month at a time. You must complete the next challenge before you can download your rental agreement. As a landlord, you must communicate in writing to your tenant all the conditions of their private rental. If you don`t, you`ll be breaking the law. An AT5 is the special message your landlord must give you if they want your rental agreement to be short and unsecured. You must receive an AT5 before changing ownership, or it will not be a short secure rental agreement. The form must be completed or it will not be official. If you do not comply with the rental conditions, your landlord can request possession of the grounds for the recovery of the property (see section 1.5). If you have lived in the property for 6 months or less, the owners must inform at least 28 days in advance if they wish to terminate the lease. If you have lived in the accommodation for more than six months, the landlord must have a minimum of 84 days in advance. The PRT also introduces detailed reasons for the removal of owners.

This means that the owners cannot evict you for no good reason. You and your tenant can conclude this contract by signing: a secure rental agreement gives you more security than a short secure rent. This means that it is more difficult for your landlord to ask you to leave the country. The most common type of agreement in the private sector is a short-term lease that has been available since January 2, 1989.
